And the other question is, would she(?) pass credit checks in the first
place?

My S-I-L, who is a British passport holder has just returned from living in
america for nearly 20 years.
She can't get a contract!

Does anyone know what are the LEGAL details for this type of contract termination?
Because in France this is a legal thing, not the subject of a vague forum discussion.
I really need to know, in order to know if I can take a 18 or 24 months contract, or if I must stay in a Pay and go option.
Thank you

Hi everybody,
Thank you for your answers.
I was actually planning to buy an iPhone or a BB with my new British
operator. But in order to have good tariffs, I need to sign for 24
months. Will I have to pay everything even if I leave back to France
after 10 months?
Thanks

Well, buy the iPhone or BlackBerry outright (SIM Free) and use one of
the shorter term options.

I think it would be a good idea to contact the mobile phone operators for a
definitive answer. It seems very unlikely they're going to let you off a
contract. You could try UK.legal.moderated.

You're asking a simple question, and the simple answer is no, you
cannot break the contract early without paying a penalty. A contract
is a contract and if you are offered one you will be expected to keep
to the terms of the agreement you made.

If were as simple as just saying you were leaving the country then
everyone could get out of their contracts by claiming they were
leaving too.

Hi,
I am a French guy coming to London for 10 months and, before taking a
new mobile contract with one of the British mobile brands (which are
usually for 18 or 24 months), I was wondering if, like what we have
here in France, I could terminate my contract after 10 months without
paying penalties on the basis of my return to France. Do you know
anything concerning this, please? Thank you very much,
Max

You can get a monthly SIM only (and use your existing phone) from O2
(and others), but a 12 month one will be cheaper even allowing for the
wasted 2 months and IIRC you can add an international caller bolt on to
call your chums in France cheaply.

Another possibility would to be to buy a SIM from Jersey telecom.

The way I read it is that the OP is wanting the phone more than the
tariff. What I would do is call the Customer Services of the company of
your choice (I would omit Vodafone) and lay your cards on the table,
openly and honestly. Tell them how long you will be here in the UK and
see what deal they can offer you. They want a sale so they may be
flexible. You won't know unless you try. A contract is a contract. What
you might try is saying 'what if I pay up front - would you give me a
discount for that?' I am sure that there will be more options than are
immediately obvious. So instead of trying to jump through loopholes in
contracts just deal with the problem 'head on' and see which operator
gives you the best deal.
Sometimes though it is better to pay for a phone upfront, unlocked, and
put a SIM in it. When you take out the deal ask them at what time will
they unlock the phone for you and how much will it cost. Unlocking isn't
always easily possible by third parties, for some phones, so you may have
to get it done by your chosen operator.

Do you mean, does one have a legal right to terminate a contact without
charge by leaving the country?

If so, the answer is no

That's because you are paying for the cost of the phone, spread over
24 months.

Will I have to pay everything even if I leave back to France
after 10 months?

Yes, because you haven't even paid for the cost of the phone after 10
months.

BTW, if it is so easy to get out of a contract in France - why not
take out another contract in France just before you leave to get a new
shiny phone there. Then you don't need to get another phone when
moving to the UK.
